香港では、金銭解雇が存在している。日本でも実質的な運用では悪徳社労士達により実際的な運用において既に行われている。

雇傭条例第９条では、資本家は通知予告もしくは解雇予告手当なしで即時に雇傭契約を解除する権利が保障されている。これは、日本の労基法でいう懲戒解雇そのものである。外観上即時という意味ではなく、一切の補償がない即時発効する懲戒解雇なのである。

日本でも諸手当の定義が、契約上支払いが確約された性質か、あくまで酌量として、支払うか否かは資本家の裁量に託された性質の手当かは軽視できない。その手当が確約されたものか？酌量によるものかの峻別は求人段階で見極めるべきである。
